YMCA of Canberra Sailing Club Waiver
1. I the course applicant, and if being a minor my parent/s and guardian/s for and on behalf of myself, acknowledge that it is a condition of participation in YMCA of Canberra Sailing Club courses and events that we make the following representations and warranties and we hereby do so.
2. In this agreement, YMCA of Canberra includes its directors, officers, employees, voluntary workers, agents and contractors.
3. I agree to personal details such as name, age, gender and performance being shown in published results.
Acknowledgement of risk
4. I agree that it is my decision to participate in the course or event at my own risk.
5. I agree to follow the instructions as provided by YMCA staff and volunteers in regards to my safety and the safety of others.
6. I am aware of the inherent and extrinsic risks to my/our health, life and property in participating in sailing and aquatic related courses and events and agree to do so at my own risk;
7. I agree to waive, release and discharge forever the YMCA of Canberra in relation to any personal injury or death to myself or otherwise resulting from, or arising out of, my participation in the YMCA Sailing Club courses or events(the “Waiver”)
8. I acknowledge and agree that the Waiver shall extend to any personal injury or death to myself caused by:
a. the negligence, action or inaction of the YMCA of Canberra or other users of, or persons present at, the Facilities but excluding any reckless conduct of the YMCA of Canberra causing significant personal injury within the meaning of section 139A of the Competition and Consumer Act 2010 (Cth);
b. my own negligence, action or inaction;
c. my failure to follow the advice or instructions from the YMCA of Canberra concerning my use of the Facilities; or
d. my failure to disclose to the YMCA of Canberra any injuries, disabilities, illnesses and ailments, whether past or present, that may affect my ability to use the Facilities or the YMCA of Canberra’s ability to provide me with advice in relation to the same.
9. I agree to defend, indemnify and hold harmless the YMCA of Canberra from and against any claim, cause of action, liability or judgment resulting from, or arising out of, or in connection with my participation in YMCA Sailing Club courses or events to which the waivers in Clauses 7 and 8 apply.
Medical and treatment costs
10. I acknowledge that individual personal accident insurance is not included in my participation. In the event of injury, accident or illness, I consent to receiving initial first aid treatment and paying all costs associated with any ambulance transportation and ongoing medical treatment.
Public Relations
11. I acknowledge that by entering into this course I am automatically granting the YMCA of Canberra the right in perpetuity to make, use or show from time to time for marketing or public relations purposes any motion pictures, still pictures and/or live taped or film television or other reproduction of myself created during the course or event.
Privacy:
12. I/ We understand that the YMCA of Canberra will pass on my name, address, phone number and email as provided on this application form to Yachting Australia.
13. I /We understand that my personal details will not be provided to any third party, other than that outlined in clause 12, without my authorisation.
14. I understand that course fees are not refundable unless the course is cancelled by the YMCA of Canberra.
15. I /we acknowledge that the information given on this form or otherwise provided by me /us (or my parent/s or guardian/s) to the YMCA of Canberra is true and correct.
