YMCA Sailing Club Racing Participation Agreement

Agreement

1. I/We the race applicants, and if being a minor my parent/s and guardian/s for and on behalf of myself, acknowledge that it is a condition of participation in YMCA Sailing Club (YMCASC) races and regattas that we make the following representations and warranties and we hereby do so.
2. In this agreement, YMCA Canberra Region includes its directors, officers, employees, voluntary workers, agents and contractors.
3. I/We agree to personal details such as name, age, gender and performance being shown in published results.

Acknowledgement of risk

4. I/We are aware of the inherent and extrinsic risks to my/our health, life and property in participating in races and regattas and agree to do so at my/our own risk;
5.  I/We agree to assume all responsibility for any personal injury or death to myself or others resulting from, or arising out of, participation in the YMCASC.

Release of YMCA Canberra Region and indemnity

6. I/We agree to waive, release and discharge forever the YMCA Canberra Region in relation to any personal injury or death to myself or otherwise resulting from, or arising out of, my participation in YMCASC races and regattas (the “Waiver”)
7. I/We acknowledge and agree that the Waiver shall extend to any personal injury or death to myself caused by:

1. the negligence, action or inaction of the YMCA Canberra Region or other users of, or persons present at, the Facilities but excluding any reckless conduct of the YMCA Canberra Region causing significant personal injury within the meaning of section 139A of the Competition and  Consumer Act 2010 (Cth);
2. my own negligence, action or inaction;
3. my failure to follow the advice or instructions from the YMCA Canberra Region concerning my use of the Facilities; or
4. my failure to  disclose to the YMCA Canberra Region any injuries, disabilities, illnesses and ailments, whether past or present, that may affect my ability to use the Facilities or the YMCA Canberra Region’s ability to provide me with advice in relation to the same.

8. I/We agree to defend, indemnify and hold harmless the YMCA Canberra Region from and against any claim, cause of action, liability or judgment resulting from, or arising out of, or in connection with my participation in YMCASC races and regattas to which the waivers in Clauses 6 and 7 apply.

Sailor to bear medical and treatment costs

9. I/We acknowledge that individual personal accident insurance is not included in my participation. In the event of injury, accident or illness, I/We consent to receiving initial first aid treatment (if the YMCA Canberra Region considers it appropriate) and paying all costs associated with ambulance transportation (if required), and ongoing medical treatment.

Photo and Video Permission

10. I give permission for myself and my crew, as listed on this form, to be photographed and/or videoed whilst participating in regattas and events run by the YMCA Sailing Club (YMCASC). I consent to the YMCA using these photos and/or videos for marketing and public relations purposes.

Racing Rules of Sailing

11. I and my (and my crew and our) supporters agree to be bound by the Racing Rules of Sailing as amended by the Sailing Instructions.

Accuracy

12. I/We acknowledge that the information given on this form or otherwise provided by me/us (or my parent/s or guardian/s) to the YMCA Canberra Region is true and correct.

Safeguarding Children and Young People 

13. YMCA Canberra Region (YMCA) is committed to ensuring the safety and wellbeing of children, young and/or vulnerable people attending YMCA activities.

 14. YMCA Canberra Region (YMCA) is committed to ensuring the safety and wellbeing of children, young and/or vulnerable people attending YMCA activities. I/We agree to be bound by the ‘YMCA Safeguarding Children and Young People’ policy and to adhere to its Code of Conduct when engaging with children. If you see any behaviors that you believe are putting any children or young people at risk please inform the race director.
