Event Waiver
I am aware that neither Zeekoe Vlei Yacht Club nor its staff nor its sailing instructors accept responsibility for any loss, injury or damage that the person or property may sustain whilst engaged in any sailing activity. I waive any right that I may have to claim compensation against Zeekoe Vlei Yacht Club or any of its staff or instructors or any other Member in respect of any loss, injury or damage incurred whilst engaged in any sailing activity howsoever arising and whether as a result of negligence or otherwise and I indemnify them against all such claims.
Hire of Boats: Hire and training fees are payable in advance. Hired boats may not be removed from the Club premises and must be stored at the Club. In the event of loss or damage of equipment, other than arising from fair wear and tear, the hirer undertakes to replace, repair or the payment thereof. The hirer undertakes to return the boat and equipment on or before completion of the course.
The hirer has no right of renewal. Should the hirer wish to hire the boat for a second training course or subsequent period, he should advise the Secretary at least one month in advance and only if a boat is available will it be allocated to the hirer. A hirer is only eligible to hire a boat for two training courses. Thereafter first-time hirers will be given preference and only if a boat is available will third-time hirers be invited to have the use of it.
Photograph Release:I hereby grant my express consent and permission to Zeekoe Vlei Yacht Club, to the rights of my, or my child’s image and likeness without payment or any other consideration. I understand that my image may be used, broadcasted, edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image. I also understand that this material may be used in diverse settings within an unrestricted area.
Photographic images of me or other use of my likeness in whole or in part, and any reproductions thereof, may be used worldwide for advertising, promotion, publicity, trade merchandising, public relations, media purposes, on-line and/or marketing video and photography to be shared on any website or for media purposes and for any other lawful purposes whatsoever. By signing this release, I understand further that this permission signifies that photographic images of me may be electronically displayed via the Internet or in a public or social setting. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. By signing this form, I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material.
