PARTICIPANT WAIVER, RELEASE OF LIABILITY & TERMS AND CONDITIONS
READ BEFORE ACCEPTING
In consideration of being allowed to participate in Zany Sports’ athletic sports program, related events and activities, the accepter acknowledges, appreciates, and agrees that:
RISK OF INJURY IN A SPORTING ENVIRONMENT
1) The risk of injury from the activities involved in this program is significant, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
2) I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3) I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4) I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Zany Sports their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
PLAYER EXPECTATIONS
5) I agree to comply with the Zany Sports code of conduct and acknowledge my involvement may be terminated by engaging in but not limited to aggressive, anti-social and unsportsmanlike behaviour.
MEDIA RELEASE
6) I give permission for Zany Sports to video and/or photograph my participation in its activities and use said footage for social media, local newspaper and promotional activities. I will notify a representative if I do not want it to be so.
EMAIL SUBSCRIPTION
7) I give permission to be added to the Zany Sports mailing list to keep informed on upcoming seasons & events.
REFUND/DROP OUT POLICY
8) Individual registration fees are non-refundable. Teams who drop out mid-season will be required to pay for rounds played if they haven’t already done so. Team fees are not refundable due to a change of mind; however, team fees are refundable only in the circumstances in which we can’t deliver our services due to external factors or COVID-19 related government restrictions.
COVID-19
9) I agree to maintain regular hand hygiene practices, not share equipment & maintain social distancing where possible. I will not attend if I am feeling unwell and have a temperature or flu-like symptoms. If I am at high risk or expose myself to those that are high risk such as the elderly or immune compromised, I will reconsider my need to participate. I will adhere to all COVID Safe instructions by Zany Sports and its stakeholders.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I ACCEPT IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
