Acknowledgment, Waiver and Release of Liability and
Agreement relating to COVID-19 (SARS-CoV2)


 

Serious Risk: The novel coronavirus, COVID-19 also known as SARS-CoV2 (hereinafter “COVID-19”), has been declared a global pandemic by medical/health organizations. COVID-19 is extremely contagious and is believed to spread from person-to-person contact. Federal, Provincial, and local governments have recommended social distancing and have prohibited the congregation and gathering of large groups.

 

Participation is voluntary and has risk: Because of the close proximity of participants involved, and the inability to supervise participant’s activities elsewhere, HARBOUR CITY WRESTLING CLUB cannot guarantee that you or your child(ren) will not become infected with COVID-19. The voluntary participation in the Club’s activities could increase your and your child(ren)’s Risk of contracting COVID-19 despite any safety and other preventive measures that may be implemented by the Club.

 

Acknowledgement of Risk: By agreeing to this Acknowledgment and Waiver and Agreement:

 

  • I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or become infected by COVID-19 by attending activities of the Club.

  • I acknowledge exposure or infection could result in illness, permanent disability, and death (the “Risks”).

  • I understand and acknowledge the Risks by becoming exposed to or infected by COVID-19 during activities of the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club directors, coaches, employees, volunteers, program participants, and their families.

 

Voluntary Assumption: For myself, and my children, I voluntarily agree to assume all of the foregoing Risks and accept sole responsibility for any and all illness, personal disability, and death as a result of same for my child(ren) or myself (including, but not limited to, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the activities of the Club or subsequent participation in any Club programming (“Claims”).

 

A Waiver and Release of Liability: On my behalf, and on behalf of my children, I hereby waive, release, covenant not to sue, discharge, and save harmless and waive any and all claims relating to the Club, its directors, coaches, employees, volunteers, program participants, agents, and representatives, of and from the Claims, including without limitation all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to the Risks. I understand and agree that this release and waiver includes any claims based on the actions, omissions, or negligence of the Club, its directors, coaches, employees, volunteers, program participants, agents, and representatives, whether the infection or Risks to my child(ren) or myself occurs before, during, or after participation in any Club program.

 

Agreement to follow all Preventative Measures: While acknowledging that reasonable protocols and preventative measures that may be implemented by the club may not be sufficient to prevent such Risks, such that there continues to be the serious Risks as set forth above, I acknowledge that the Club shall institute and implement reasonable protocols and preventative measures to address such Risks. By this Agreement, on my behalf, and on behalf of my children, I hereby agree to accept, act upon, and abide by, such protocols and preventative measures as may be implemented by the Club from time to time.

 

Terms & Conditions 

  • I hereby apply for temporary membership of Harbour City Wrestling Club.
  • I understand that in participating in the activities of the Harbour City Wrestling Club I am acting entirely as a volunteer. I will not hold the club responsible for any loss damage or injury resulting from my participation in activities of the club. I fully resolve the club, its members, office bearers, and associates from all responsibility for damage, loss, or injury as a result of such participation. 
  • I agree to be bound by the constitution of the the association for the time being in force. 
  • I accept the use of the word club is not used in the legal sense according to NSW law.  Our organisation is an "association" according to strict terminology.
  • By accepting the terms of registration, this is an acknowledgement of these provisions.
