Saltwater Veterans Sailing Project (SVSP)
Activity Waiver, Release & Media Consent
1. Purpose
Saltwater Veterans Sailing Project (SVSP) is an independent, veteran-led, ACNC-registered charity supporting veterans and their families by reducing social isolation and assisting those who are Wounded, Injured, or Sick (WIS). Activities are primarily volunteer-delivered and conducted in collaboration with host sailing clubs and supporting organisations.
2. Definitions
In this Agreement:

SVSP: Saltwater Veterans Sailing Project, including its officers, employees, volunteers, contractors, host organisations, and affiliates.

Participant: Any person taking part in an SVSP Activity.

Activity/Event: Any activity organised, facilitated, or supported by SVSP, including preparation, travel, and participation.

Host Organisation: Any club, marina, or organisation assisting or facilitating an Activity.

Claim: Any action, demand, loss, damage, cost, expense, or liability however arising, including negligence.
-
Recreational Services: As defined under applicable Australian Consumer Law and Civil Liability legislation.
Participation in an Activity constitutes acceptance of this Agreement as a binding contract between the Participant and SVSP.
3. Assumption of Risk & Release
Participation in SVSP Activities involves inherent risks. Examples include, but are not limited to:

Physical exertion or fatigue

Falls, slips, trips, or collisions on land or water

Capsizing, sinking, or vessel malfunction
-
Equipment failure or misuse
-
Unpredictable environmental conditions (wind, waves, tides, currents, or weather changes)
-
Sunburn, heatstroke, or cold exposure
-
Serious injury, illness, or death
-
Damage to personal property
By participating, the Participant:

Voluntarily assumes all risks; and
-
To the maximum extent permitted by law, releases, indemnifies, and holds harmless SVSP and its Host Organisations, including their directors, officers, employees, volunteers, and agents, from all Claims arising from participation, including those caused wholly or partly by negligence or by other participants.
This waiver applies to all SVSP Activities, whether paid or unpaid, until replaced by a new agreement.
4. Recreational Services — Limitation of Liability
SVSP provides recreational services. To the extent permitted by law:

Guarantees, warranties, or conditions implied by legislation (including Australian Consumer Law) are excluded.

Where liability cannot be excluded, SVSP’s liability is limited, at its discretion, to:
5. Safety & Participant Responsibilities
Participants agree to:

Follow lawful directions of organisers, instructors, coaches, skippers, or facilitators.

Act safely and comply with applicable laws and regulations.
-
Participate only when physically and mentally fit.
-
Use required safety equipment, including approved personal flotation devices, gloves, and sun protection where applicable.

Not participate while impaired by alcohol or drugs.
-
Not wear watches, rings, or jewellery, or carry items that may be lost overboard.
-
Withdraw if conditions appear unsafe or unsuitable.
-
Possess swimming ability appropriate to on-water activities where required.
Boating & Racing
-
Boating activities are inherently dangerous; participation decisions remain the responsibility of the Participant.

The skipper retains final authority regarding vessel safety and operation.
-
Participants acting as skipper are responsible for vessel and crew safety and compliance with maritime laws and International Regulations for Preventing Collisions at Sea (COLREGs).

Racing activities involve increased risk. Participants agree to comply with applicable Sailing Instructions, Notices of Race, and the Racing Rules of Sailing.
6. Health & Medical Consent

The Participant confirms they are physically and mentally fit to participate and will notify SVSP of any relevant changes prior to participation.

The Participant acknowledges the risk of accident, illness (including pandemic-related illness), or death.

SVSP or its representatives may arrange emergency medical treatment, including ambulance transport, where consent cannot reasonably be obtained.

The Participant authorises such action and accepts responsibility for associated costs.

This Agreement binds the Participant’s heirs, executors, and legal representatives.
7. Media Consent

Photographs or video may be taken during Activities.

The Participant consents to SVSP using their name, image, likeness, or performance for promotional, educational, or fundraising purposes across all media platforms.

Participants who do not wish to be photographed must notify organisers at the time.

Images supplied by Participants grant SVSP an ongoing licence for use unless otherwise agreed.

Media may be shared with supporting organisations and sponsors for similar purposes.
8. Privacy
Personal information is collected for:

Insurance and compliance

Program communication
Information is handled in accordance with applicable privacy laws. Failure to provide required information may prevent participation.
9. Participants Under 18
Participants under 18 must have this Agreement accepted by a parent or legal guardian, who:
10. Volunteers
SVSP is volunteer-led. Volunteers freely offer their (unpaid) time and may decline tasks at any time. Paid contractors operate under separate agreements.
11. Severability
If any provision of this Agreement is invalid or unenforceable, it will be read down or severed without affecting the remaining provisions.
12. Acknowledgement
By signing or agreeing electronically, the Participant confirms they:

Have read and understood this Agreement;

Agree to be bound by its terms; and

Have had the opportunity to seek independent legal advice.
This document constitutes the entire agreement between the Participant and SVSP.
13. Governing Law
This Agreement is governed by the laws of Australia.
