INSURANCE WAIVER A CONDITION OF SUBMITTING THIS TEAM LIST AND ENTRY FORM IS THAT EVERY PLAYER LISTED(and their parent/guardian for players under 18) HAS READ, UNDERSTOOD, AGREED WITH AND ACKNOWLEDGED THEFOLLOWING INSURANCE WAIVER, WARNING, EXCLUSION OF LIABILITY AND RELEASE & INDEMNITY AND WILL ASSUME WITH FULL KNOWLEDGE THE DANGERS INHERENT IN THEIR PARTICIPATION AND DO SO AT THEIR OWN RISK.

WARNING Volleyball may be a dangerous activity and accidents can occur which may result in me being injured or in my

death. I declare that I have voluntarily read and understood this Warning, Exclusion of Liability and Release and

Indemnity and accept and assume the inherent risk of injury in participating in Volleyball.

EXCLUSION OF LIABILITY

Except to the extent that terms are implied into a contract for the sale of goods and services by the Competition and

Consumer Act 2010 (Cth) or other legislation, and cannot by contracted be excluded, I agree that in consideration of

being allowed to participate in Volleyball that the Ballina Volleyball and Ballina Life Pty Ltd, its

directors, officers, employees, agents or contractors are absolved from all liability however arising from any injury or

damage however caused (whether fatal or otherwise) due to any act of negligence to the fullest extent permitted by law

(other than gross negligence), breach of duty, default and/or omission on the part of Ballina Volleyball Club or their affiliated Club Office Bearers.

RELEASE AND INDEMNITY

In consideration of Ballina Volleyball entitling me to register in the Ballina Prawnstars Tournament, I:

1. Release and forever discharge Ballina Volleyball from all actions,

suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses however arising that I may

have or may have had but for this release arising from or in connection with my involvement in Volleyball at BISC Ballina;

and

2. Indemnify Ballina Volleyball to the extent permitted under the

Competition and Consumer Act 2010 (Cth) or otherwise by law in respect for any actions, suits, proceedings, claims,

demands, losses, damages, penalties, fines, costs and expenses, arising as a result of or in connection with my

involvement in Ballina Volleyball club sport activities whether caused or contributed to, directly or indirectly, by any act of negligence

to the fullest extent permitted by law (other than gross negligence), breach of duty, default and/or omission on the part

of Ballina Volleyball Club.
