PARTICIPANT DECLARATION, RISK WARNING, LIABILITY WAIVER AND MEDIA CONSENT

1. Risk warning and acceptance of risk
I understand that sailing and catamaran racing involve risks that may result in serious injury, permanent disability, death, or loss of or damage to property.
These risks include sudden strong gusts and changing weather, capsizing, falling overboard, drowning, collisions with boats or other objects, entanglement in ropes or equipment, equipment failure, physical exertion, exposure to sun and cold, and injuries during rigging, launching, retrieving and handling boats. Rescue or medical assistance may be delayed or limited by conditions.
I acknowledge these risks and voluntarily accept the risks associated with my participation in the regatta and related activities, both on the water and ashore.
2. Responsibility, rules and insurance
I agree to be bound by the Racing Rules of Sailing, the Notice of Race, the Sailing Instructions and all other rules governing this event.
I acknowledge that rule 3 (Decision to Race) places responsibility for a boat’s decision to participate in a race or to continue racing with that boat alone. I understand and accept the risks of participation described in this waiver.
I confirm that the boat on which I will compete is covered by valid third-party liability insurance with a minimum cover of AUD $10 million per incident, or its equivalent, meeting the requirements of the Notice of Race and remaining valid throughout the event.
I am responsible for assessing my fitness, competence and ability to participate safely. I will ensure that the boat and equipment I use are suitable for the conditions and comply with applicable event requirements.
I will comply with applicable lifejacket and safety requirements and reasonable safety directions from event officials.
I understand that the provision of race management or rescue support does not guarantee my safety.
3. Liability waiver
To the extent permitted by law, I release Palm Beach Sailing Club and its officers, committee members, race officials, employees and volunteers acting in connection with the regatta from liability for personal injury, death, or loss of or damage to property arising from my participation in the regatta and related activities, including liability arising from their negligence.
To the extent permitted by section 139A of the Competition and Consumer Act 2010 (Cth), I agree that PBSC’s liability for failure to comply with the consumer guarantees relating to its supply of recreational services is excluded in respect of death or personal injury.
This waiver does not exclude liability for reckless conduct within the meaning of that section or any liability, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
4. Event photography and video
I consent to PBSC and photographers acting on its behalf recording and using photographs and video of me taken during the regatta, together with my name, for event reporting and promotion of the regatta and PBSC. This may include PBSC’s website, social media, newsletters, press coverage and promotional materials, without payment to me.
This consent does not authorise the sale of my image or its use to imply that I endorse an unrelated product or service.
If I do not wish to be identifiable in promotional photographs or video, I may notify PBSC at comm.pbsc@gmail.com before the event without affecting my eligibility to participate. PBSC will take reasonable steps to respect this request, although exclusion from incidental background images cannot be guaranteed.
I may also withdraw consent for future use by notifying PBSC. Material already published or distributed may remain in circulation.
5. Electronic acceptance and participants under 18
By ticking “I agree to the Event Waiver”, I confirm that I have read and understood this participant declaration, risk warning, liability waiver and media consent, and agree to its terms, subject to any media opt-out notified under section 4.
If I am registering another adult participant, I confirm that they have read and understood these terms and expressly authorised me to record their acceptance. My acceptance does not automatically constitute acceptance by other adult crew members.
If the participant is under 18, I confirm that I am their parent or legal guardian. I have read these terms, discussed the risks with them in a manner appropriate to their age and understanding, and consent to their participation and the media arrangements above, subject to any media opt-out I notify to PBSC. This consent does not purport to waive any rights of the child that cannot lawfully be waived.
