I acknowledge and agree that:
I confirm that I have completed a learn-to-sail or dinghy sailing course at BSYC and have been given approval by the Head Instructor to hire a Pacer dinghy. I also believe that I have the ability, experience, and competence to safely launch, sail, and return to shore without assistance.
Sailing a Pacer dinghy is a water-based activity that involves inherent risks, including but not limited to capsizing, collision, equipment failure, changing weather and wind conditions, and potential injury. I voluntarily accept all such risks.
I confirm that I am physically fit to participate, can swim competently, and have no medical condition or impairment that would make my participation in dinghy sailing unsafe.
I acknowledge that wearing a personal flotation device (PFD) is mandatory while participating in Pacer hire activities with Brighton & Seacliff Yacht Club (BSYC). A helmet will be provided by BSYC and may be worn at the participant’s discretion. Participants who choose not to wear a helmet do so at their own risk, and BSYC accepts no liability for any injury, loss, or damage resulting from that decision.
I agree to remain within the designated sailing area at all times, follow all safety instructions provided by BSYC staff, and return to shore immediately if instructed to do so due to safety or weather conditions.
I accept full responsibility for the care and proper use of the hired Pacer dinghy and all associated equipment, and agree to pay for any damage, loss, or costs arising from misuse or negligence.
To the fullest extent permitted by law, I release and indemnify Brighton & Seacliff Yacht Club, including its staff and volunteers, from all liability arising from or in connection with my participation in Pacer dinghy hire activities.
I confirm that I am not under the influence of alcohol or drugs at the time of participation.
If signing on behalf of a minor, I confirm that I am the parent or legal guardian and accept full responsibility for the minor’s participation.
