By registering for this event, you acknowledge that you are voluntarily participating in gravel cycling activities that involve inherent and significant risks. You agree to release, waive, and discharge the Organiser from liability to the fullest extent permitted by law.

1. Description of Activities

I understand that gravel cycling activities may include, but are not limited to:

• Riding on unsealed roads, tracks, trails, and remote terrain
• Steep ascents and descents
• Variable and unpredictable surfaces (gravel, sand, mud, rocks)
• Exposure to weather extremes (heat, cold, rain, wind)
• Interaction with vehicles, wildlife, livestock, and other trail users
• Mechanical failures, falls, collisions, and rider error
• Limited access to immediate medical assistance

3. Australian Consumer Law (ACL) Risk Warning

Important Risk Warning – Section 139A Competition and Consumer Act 2010 (Cth)

Under Australian Consumer Law, certain consumer guarantees may not apply to recreational services.

By signing this agreement, you acknowledge and agree that, to the extent permitted by law, the Organiser excludes liability for death, personal injury, or illness suffered by you that is caused by the supply of recreational services, including gravel cycling activities.

This exclusion applies whether the harm arises from:

• The inherent risks of the activity
• The materialisation of obvious or significant risks
• The negligence of the Operator or its representatives

You acknowledge that gravel cycling is a recreational activity involving a significant degree of physical exertion and risk, and you agree that you participate at your own risk.

4. Assumption of Risk

I acknowledge that gravel cycling is a potentially dangerous activity and involves inherent risks that may result in injury, illness, property damage, permanent disability, or death. I voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, even if arising from the negligence of the Organiser, to the maximum extent permitted by law.

5. Medical Fitness

I declare that:

• I am physically and medically fit to participate in gravel cycling activities
• I do not suffer from any condition that would increase my risk of injury or illness
• I have disclosed any relevant medical conditions, allergies, or medications to the Operator
• I am responsible for managing my own health and taking prescribed medication as required

I understand that the Organiser does not provide medical advice or diagnosis.

6. Use of Equipment

I acknowledge that:

• I am responsible for ensuring my bicycle and equipment are safe and suitable
• Helmets are mandatory and must be worn at all times while riding
• The Organiser is not responsible for damage to personal equipment

7. Release and Waiver of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Operator, its owners, employees, contractors, volunteers, guides, land managers, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to my participation in gravel cycling activities, including but not limited to those arising from negligence.

8. Indemnity

I agree to indemnify and hold harmless the Organiser from any loss, liability, damage, or cost (including legal fees) arising from my participation in the activities or from any breach of this agreement.

9. Insurance

I understand that the Organiser does not provide personal accident, health, ambulance or travel insurance. I am responsible for obtaining my own appropriate insurance coverage.

10. Photography and Media (Optional)

I consent to the use of photographs or video recordings taken during the activity for promotional and marketing purposes. Please inform organisers if you do not wish your image to be used.

11. Governing Law

This agreement is governed by the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.

12. Severability

If any part of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Acknowledgement 

I confirm that:

• I have read and understood this agreement
• I understand that I am giving up substantial legal rights
• I accept this agreement freely and voluntarily

For Participants Under 18 Years of Age

I am the parent or legal guardian of the participant and consent to their participation. I agree to all terms of this agreement on their behalf.
